ADULT INDUSTRY COMPLIANCE STATEMENT

1. Scope of SinTree’s duties in law

SinTree is not the producer (whether primary or secondary as defined in 18 U.S.C. § 2257) of any of the content found on this site. SinTree’s activities, with respect to such content, are limited to the transmission, storage, retrieval, hosting and/or formatting of depictions posted by third party users, on areas of the website under the user's control.

Please direct any request you may have regarding §2257 records in relation to any content found on SinTree, directly to the respective uploader, amateur, producer, studio or account holder of the content.

2. SinTree’s policy on ‘2257’ requirements

Notwithstanding 1 above, and although SinTree is based in the United Kingdom, it is intended that we will have regard to the laws of the United States, and in particular:

- U.S. Code Title 18, Sections 2257 and 2257A, Title 28, Part 75 of the Child Protection Restoration and Penalties Enhancement Act of 1990;

- the Protect Act; and,

- the Adam Walsh Child Protection and Safety Act of 2006.

Our compliance with these U.S. statutes will be within the scope set out in 1 above and to the extent that these do not conflict with the laws of the United Kingdom.To that end, we are issuing this voluntary Adult Industry Compliance Statement.

3. What do the U.S. statutes require?

The statutes mentioned above are criminal regulations that require producers of adult content to create and maintain records that verify the age of adult performers. The law also requires that certain specified compliance statements must be affixed to content subject to the 2257 Regulations indicating where the records are available for unannounced inspection by the authorities of the United States.

A copy of our proforma 2257 Compliance Statement is annexed below.We encourage all content providers on this site to make use of the wording in that proforma.

4. Why issue this Statement?

We support all measures that work to prevent and eradicate sexual exploitation and abuse of adults and minors. Furthermore, our compliance procedures are designed to comply with the standards and protocols of responsible operators in adult social media, ensuring a safe and seamless experience for our users and performers.

5. What practical measures has SinTree put in place?

We have taken the following steps:

• All Performers must be over eighteen (18) years of age (or the age of majority required by their jurisdiction, if that is greater than 18).

• The Performer as producer of content must certify to us that he or she is compliant with record keeping requirements under U.S.C. § 2257 for all content uploaded on SinTree, and agrees to deliver such documentation promptly upon request.

• The uploaded content much not breach our various terms of service or our Acceptable Use Policy.

• We have effective controls in place to monitor, block and, where necessary, take down all illegal content.

• We only permit uploads from verified Performers. To ensure this, we have in place robust process for verifying the age and identity of the Performer by means of government-issued ID.
• Similarly, Performers must verify the age and identity of all persons depicted in the content, to ensure everyone is an adult. And be able to provide supporting documentation on request.

• We have detailed and comprehensive terms of use in place with each Performer. Individual Performers will be required to obtain and keep on file written consent from all persons depicted in the content.

• We reserve the right to invoke a pre-screening requirement for performers in which content is reviewed prior to publication to ensure that it is not illegal and does not otherwise violate our acceptable use standards. Real-time monitoring and content removal is also in place for live streaming.

6. What other steps are SinTree taking in regard to sexual exploitation?

We undertake extensive vetting of all Performers on our site to ensure that age and identity requirements are met.All Performers must be aged at least 18 and must have a verifiable identity and home address.

We strongly encourage – and in many cases will expressly require - content providers on this site to attach a 2257 Compliance Statement to their content, where the exemption in 8 below does not apply to that content.All profiles and streamed content includes a ‘Report’ function and we encourage users to make use of this to alert us to exploitative or abusive content and content that may otherwise be illegal.

7. How can users of the site help?

As stated above, users should make use of the ‘Report’ function.We also ask users to co-operate with us in any vetting or background checks we undertake and to comply with our various terms of use and the Acceptable Use Policy.

8. Exempt Content

Visual depictions displayed on this Website that do not involve actual or simulated sexually explicit conduct are exempt from the provision of Section 2257 because: 1) they do not portray conduct as specifically listed in 18 U.S.C §2256 (2)(A) (i) through (iv); 2) they do not portray conduct as specifically listed in 18 U.S.C. §2257A produced after March 19, 2009; 3) they do not portray conduct listed in 18 U.S.C. §2256(2)(A)(v) produced after March 19, 2009; 4) the visual depictions were created prior to July 3, 1995; or, 5) SinTree does not act as a “producer” with respect to the dissemination of such exempt images as that term is defined in 28 C.F.R. §75.1(c).
